GENERAL CONDITIONS AND BOOKING RATES
INTRODUCTION
The purpose of this document is to provide information on the general conditions applicable to the management of reservations through our Booking Engine system (hereinafter BE).
On the BE system you will find information on the availability of rooms, rates and services offered by the accommodation facilities managed by ACCOGLI SRL (from now on ACCOGLI).
The management of reservations implies full and unconditional acceptance of the legal notice, the privacy policy and these general conditions in their latest updated version. Therefore, before making any reservation and each time you access our BE system, we recommend that you read these conditions, as we reserve the right to modify, add or remove any part of these conditions at any time.
CLAUSES
The formalization of reservations through the BE system is subject to the following clauses:
1. STATEMENTS:
The user declares under her responsibility:
- To be of age and have full capacity to formalize the reservation, declaring that they understand all the conditions present in the BE system.
- That the information provided at the time of booking is true, complete and concise.
- Confirming the requested reservation and in particular the dates indicated, the number of rooms, the number of people, the accommodation and the formula chosen.
2. ACCESS TO THE BE SYSTEM
Access to this BE system is the responsibility of the user.
3. SUBSCRIPTION TO PRODUCTS AND SERVICES THROUGH THE BE SYSTEM:
3.1. The reservation includes the services detailed according to the reservation conditions stipulated on the BE system in which such reservation is requested or formalised.
3.2. ACCOGLI will be responsible, towards the user, for compliance with the obligations deriving from current legislation and from the terms and conditions of sale of all the products and services subscribed. The user accepts that ACCOGLI does not assume any obligation or responsibility with regard to the services it does not provide directly (in particular, with regard to the lack of truthfulness, completeness, updating and/or accuracy of the data or information on offers, products or services, prices, characteristics and any other relevant data and information regarding products and services not provided directly by ACCOGLI).
3.3. Before formalizing the reservation, the user must accept these general conditions. The contract can be validly formalized in any of the languages available on the BE system.
4. THE PROCESS FOR FORMALIZING THE RESERVATION ON THE BE SYSTEM TAKES PLACE IN 4 PHASES:
a) Availability: Search for dates, number of people and rooms.
b) Choice of regime and type of room, tariff.
c) Summary of the reservation, collection of customer data and, if applicable, payment by Credit Card, Bank Transfer, PayPal or Remote POS.
d) Confirmation of booking.
Once the reservation has been made, the emails and logs generated by the operation will be archived. The customer will receive the details of his reservation via email or messaging systems.
5. PRICE AND PAYMENT:
5.1. The conditions, price and payment of the envisaged stay are those expressly established in the tariff conditions included in the BE system in which the reservation is made.
5.2. The promotions and offers will be valid only during the period in which they remain accessible to the recipients of the service and in any case not after completing the booking: from that moment on, the selected rates/promotions remain unchangeable.
5.3. The prices indicated on the BE system are retail prices including VAT. The transaction will be made in EURO, regardless of the customer's origin.
6. CANCELLATIONS/CHANGES TO BOOKINGS AND NO SHOWS:
6.1 Depending on the applicable conditions according to the rate selected by the customer.
6.2. All charges applied can be made to the credit card provided during the booking. In doing so, you expressly consent to the charging of these expenses to cover any applicable penalties in the event of cancellations or no-shows.
6.3 In case of:
a) cancellation after the terms set out in the selected rate conditions;
b) no-show;
c) early departure with respect to the period selected and/or communicated at the time of booking and/or check-in, a cancellation penalty equal to 100% of the entire value of the stay will be charged or no refund will be provided in the event of payment already made.
7. NOTIFICATIONS
All notifications, requirements, requests and other communications that must be made by the parties in relation to these general conditions must be sent via email to [email protected].
8. NULLITY OF THE CLAUSES
If one or several clauses included in these general conditions were to be declared totally or partially null or ineffective, this will only affect that provision or that part which has been so declared, while the general conditions will remain valid in all other respects and such provision, or the part of the same concerned, will be considered as not in force.
9. ACCEPTANCE
The request and the formalization of the reservation necessarily imply the acceptance of each of these general conditions, considered as an integral part of the reservation and completed with the tariff conditions and the specific applicable legislation.
10. APPLICABLE LAW AND JURISDICTION
This contract is governed by Italian law and for any dispute that may arise with respect to its validity, execution, fulfillment or termination, in whole or in part, the parties expressly submit to the jurisdiction and competence of the Courts of Lecce (Italy).
